Abstract

This research focuses on studying and verifying the manuscript titled "The Best Sayings Regarding the Prohibition of Action" from the book "Al-Iman Bi Al-Tamam Wa Al-Kamal," authored by the esteemed scholar Hasan Al-Sharnbalali Al-Hanafi, who passed away in 1069 AH. This study was a response to a question posed to Sheikh Sharnbalali regarding an oath taken by some soldiers not to return to Egypt. The content revolves around some soldiers who were expelled from Egypt and swore not to return, but later received an order from Sultan Muhammad Ibrahim Pasha to re-enter Egypt. The oath-takers questioned the validity of their oath in this new scenario. Sheikh Sharnbalali's response summarized that they could re-enter Egypt without violating their oath because they did not own Egypt; the sovereign authority over Egypt belonged to the Sultan. If the Sultan verbally allowed their entry without taking any action, they would not be violating their oath. Sheikh Sharnbalali justified his fatwa by stating, "The ruling in this case is based on the ownership and non-ownership of the place, and the ruling is based on this premise." He elaborated on the issue by citing the opinions of the Hanafi jurists, referring to their books and fatwas. The thesis was completed in Muharram 1062 AH, along with a biography of the esteemed scholar Hasan Al-Sharnbalali Al-Hanafi.
