The Behavioral Jurisprudential Method of Imam Al-Qurtubi In His Book "Al-Jami` Li Ahkam Al-Quran"

Abstract

"Imam al-Qurtubi" used to receive knowledge from more than one sheikh، so he turned to them when he was exposed to a fatwa that he needed to reveal the fatwa in. He asked more than one sheikh، and he used to perpetuate the consideration of scientific issues and was not satisfied with the issues of rulings with a fatwa he heard، even if it was one of his eminent sheikhs; Because his method of exploration and research، where he did not find anything wrong with retracting an opinion that he was satisfied with، and if it is proven to him that there is another opinion that is more appropriate to follow. He did not fantasize about the doctrine، so he would prefer it even if his argument was weak، but he would prefer other doctrines if he saw the truth beside him and depart from the Maliki doctrine and declare his opposition to it He also did not hesitate to present the opponent’s argument or bring it truncated and loose، but rather he presented it accurately and honestly، and even gave it a lot of explanation and clarification.

"Imam al-Qurtubi"، although he belonged to "Maliki" school ، he was not a supporter of everything that his school decided but he was distinguished by following the legal evidence in what his school sees، and no evidence is established on it. When we meditate on the interpretation of Al-Qurtubi، we find that he was a fundamentalist jurist.  jurisprudential opinion.
